The Alleged Resurgence of Natural Law Theory

Published in 1916, the article analyses the supposed resurgence of Natural Law theory. Having shown that the legal literature of his time continued to rebut the thesis of Natural Law, the author argues that law reflects social needs, which vary according to the organization of each society and the determination of its living conditions and development. Therefore, although Law is a universal phenomenon–since it would not be possible to conceive of a society without order–it cannot be claimed that there exists a Law with universal content, identical for all times and places, as Natural Law proposes.
