Procedural considerations on the motion to pierce the corporate veil: the adoption of the common procedure and the problem concerning the awarding of attorneys' fees

The scope of this article is to discuss procedural matters concerning the motion to pierce the corporate veil: the adoption of common procedure and the awarding of attorneys' fees in favor of the counsel of the winning party, especially after the uniformization of case law from the Superior Court of Justice, although it was not followed in the recent judgment of Special Appeal No. 1925.959/SP by the Third Panel of the same Court. The article puts forward the hypothesis that the common procedure should be adopted and that the losing party in the motion to pierce the corporate veil is subject to awarding the counsel of the winning party attorney’s fees. It also aims to review legal literature supporting this position and to demonstrate the inaccuracy of opposing views. The paper is established within the framework of the due process of law clause.
